The Dispute

A family of five European business migrants (the Applicants), having lived and conducted businesses in Australia for more than four years, engaged a migration agent (the Agent), to prepare business visa applications for permanent residency (the Applications) to the Department of Immigration (Department).

The Applications were refused by the Department (the Refusal) due to procedural non-compliances and failure by the Agent to rectify the defects (the Negligence).

The Applicants sought review of the Refusal by the Administrative Appeals Tribunal (the Appeal). The Appeal was also refused by reason of the Negligence. Accordingly, the Applicants were denied further residency in Australia and were required to return to Europe and therefore cease the conduct of their Australian businesses.

The Claim

By reason of the Negligence and Refusal, the Applicants incurred substantial expenses and suffered significant past and future economic losses and other damages (the Damages).

Solve Global’s predictive analytics of the Claim

Solve Global was retained to pursue recovery of the Damages (the Claim). We prepared a claim for the Damages, comprising detailed data analysis (legal and non-legal) and predictive modelling of the probable and potential outcomes of the Claim if taken to Court. The Claim resulted in the Agent’s PI Insurer (the Insurer) engaging with Solve Global to negotiate a settlement of the Claim, without resort to litigation.

The Solution

Solve Global’s future predictive outcome modelling, persuaded the Insurer to offer all the Agent’s available insurance indemnity fund in settlement of the Claim. Therefore, the Claim was settled within a few months of notification and negotiation, avoiding two years of litigation and significant legal costs.

The Applicants were delighted, compensated and freed to pursue their business interests and lives without further disruption.
